Declaración responsable (works notice)
Renovations that don't touch the structure, façades, roofs or fences: we tell you whether a declaración responsable is enough or you need a licence, and we prepare it for you.
Not all works need a licence. For many renovations it is enough to submit a declaración responsable: a document in which the developer declares that the works comply with regulations, accompanied by the technical documentation the town hall asks for. It is quicker than a licence, but the responsibility is the same: if the works don't comply, the town hall can stop them and impose a fine.
Which works go through a declaración responsable
In the Valencian Community, the TRLOTUP separates works that need a licence (article 232) from those that go through a declaración responsable (article 233). In plain language:
- They need a licence: new builds, extensions, works affecting the structure, plot divisions and earthworks, and works on listed buildings.
- A declaración responsable is enough: renovations that don't alter the structure, maintenance works, façade renovations on unlisted buildings, walls and fences, and first and subsequent occupancy.
In the Region of Murcia the arrangement is similar, under Law 13/2015.
Each town hall sets out in its bylaw what documentation must be provided: sometimes a description and a budget are enough; other times, a technical report or a signed project.
How we do it
- Visit to see the works you want to carry out and confirm they don't need a licence.
- Technical documentation: report, drawings, budget and whatever your town hall asks for.
- Submission of the declaración responsable and, if needed, the permit to occupy the public road for scaffolding or a skip.
- Site supervision, if the works require it or if you want us to oversee them.
Frequently asked questions
Can I start the works the next day?
In general, the declaración responsable entitles you to start from the moment you submit it complete. Even so, always check whether your town hall asks for anything else, and don't start without the registered copy.
What taxes and fees are payable?
The construction tax (ICIO) and the municipal fee, set by each town hall. They are calculated on the budget for the works.
What happens if I do the works without declaring them?
It is a planning offence: the town hall can halt the works, fine you and require them to be legalised or reversed. It can also cause you problems when selling or when applying for the second occupancy.
