Plot division (segregación)
Division and merging of urban and rural plots: feasibility study, georeferenced drawings and subdivision licence or declaration that no licence is required.
Plot division (segregación) means splitting a property into two or more separate properties, each with its own entry in the Land Registry and its own cadastral reference. It's common for dividing an inheritance, selling part of a piece of land or separating a house from its orchard.
Can any land be divided?
No. Each resulting plot has to comply with the municipality's planning rules: minimum area, minimum frontage, access, etc. On rural (rústico) land you also have to respect the minimum farming unit and the restrictions on non-developable land. That's why the first thing we do is check whether it's feasible.
What's needed
For the notary to authorise the deed and the Land Registry to register it, the law requires a plot division (parcelación or segregación) licence from the town hall or, in some cases, a declaration that no licence is required (declaración de innecesariedad) for it. In the Valencian Community this is governed by the TRLOTUP; in Murcia, by the Region's Law 13/2015.

- Preliminary study: deed, Cadastre and planning rules to see whether the resulting plots comply.
- Survey of the property and proposed division.
- Plot division drawings showing the original and resulting properties, georeferenced in GML format.
- Processing the licence at the town hall and coordination with the notary.

And what if I want to join two plots?
That's a merger (agrupación) and the process is similar, usually simpler. We do that too.
Can I sell part of the land as an undivided share (“en proindiviso”)?
Selling percentages of a property so that each buyer uses a specific part is a form of covert subdivision, and land registrars usually block it. Better to do it properly from the start.
